Staff recommends that the Planning Commission concur with the Director’s analysis and findings, and deny the rezone request of the subject parcel from D5 to D10, and the subject parcel remains in a D5 zoning district.
Should the Planning Commission recommend approval of the requested rezone of the subject parcel from D5 to D10 to the Assembly, the following condition is recommended:

Prior to a zone change from D5 to D10, the property owner shall obtain and develop legal access to the subject parcel from Forest Lane or Dudley Street, in conformance with CBJ Code 49.35.240 and 49.35.250.
